Terms of Service

1. General

1.1. These Terms of Service (the "Agreement") govern the relationship between the EchoTip software platform (referred to as "EchoTip", "Platform", or "we") and any person using the EchoTip service available at echotip.app (the "Website" or "Service").

1.2. By using the Service you confirm that you have read and fully accept this Agreement. If you do not agree, please discontinue use of the Service immediately.

1.3. This Agreement constitutes a public offer within the meaning of Article 437 of the Civil Code of the Russian Federation.

2. Definitions

Service (Platform) - the EchoTip software product designed to help streamers receive donations and display real-time notifications during live broadcasts.

User - any person who has registered on or is using the Platform.

Streamer - a User who has created a donation page and connected the Platform to their live streams.

Donor - a person who sends a voluntary donation to a Streamer through the Streamer's own payment account.

Donation - a voluntary, gratuitous payment made by a Donor directly to the Streamer's own YooKassa payment account.

Subscription - a paid EchoTip service granting the Streamer access to Platform features for the paid period.

Overlay - a software component displayed over the video stream in OBS Studio or similar applications.

3. Scope of the Agreement

3.1. EchoTip provides Streamers with a software tool for: - creating a personal donation page; - displaying donation notifications in the stream via an OBS overlay; - playing text messages, audio and video attached to donations; - managing the donation queue in real time; - customising the appearance of notifications.

3.2. EchoTip is a software platform only and is not: - a payment agent, payment system operator or payment intermediary; - a party to the payment relationship between a Donor and a Streamer; - a recipient, custodian or organiser of donor funds.

3.3. Donor funds are transferred directly to the Streamer's bank account or YooKassa wallet. EchoTip has no technical capability to hold, redirect, refund or otherwise control donor funds.

3.4. Payment transactions between Donors and Streamers are carried out through the Streamers' own YooKassa accounts and are governed by YooKassa's terms.

4. Registration and Account

4.1. Registration is required to use the Service as a Streamer.

4.2. You must provide accurate information when registering. EchoTip may suspend an account if false information is detected.

4.3. You are responsible for keeping your login credentials safe. Report any unauthorised access immediately to [email protected].

4.4. Registration is only permitted for persons aged 18 or over.

4.5. Each person may register no more than one Streamer account.

5. Subscription and Payment

5.1. Access to the Service features is provided on a paid subscription basis. Current pricing is published on the Website.

5.2. The subscription is paid in advance for the chosen period. The subscription does not renew automatically - the Streamer must manually pay for each new period.

5.3. EchoTip does not process donations and is not a party to the payment relationship between Donors and Streamers. The subscription fee covers access to the software only.

5.4. The subscription becomes active upon receipt of payment. Access to paid features is suspended when the paid period expires.

5.5. Subscription fees are non-refundable, except where the Service was entirely unavailable due to EchoTip's fault for more than 72 consecutive hours - in which case a pro-rata refund is issued for the period of unavailability.

5.6. EchoTip may change its pricing with at least 30 days' prior notice. Changes do not affect already-paid periods.

6. Streamer Obligations

6.1. The Streamer agrees to: - independently obtain sole-trader or self-employed (NPD) status and accept donations within the framework of lawful activity; - independently enter into an agreement with YooKassa and comply with its rules; - independently fulfil all tax obligations in respect of donations received; - not use the Platform to collect funds for unlawful purposes, including financial pyramids, gambling, or charitable fundraising without proper registration; - ensure that the content on their page complies with applicable law; - not accept donations from persons under 18.

6.2. The Streamer bears sole and full responsibility for: - all payment transactions through their YooKassa account; - payment of taxes on donations received; - compliance of their activities with the legislation of the Russian Federation; - content published on their page; - resolving payment-related disputes with Donors.

7. Donor Rules

7.1. By sending a donation, the Donor confirms that: - the donation is voluntary and does not entitle the Donor to any goods, services or reward of any kind; - the payment is made directly to the Streamer's YooKassa account - EchoTip is not the recipient of the funds and has no access to them; - EchoTip does not participate in the movement of funds and bears no responsibility for payment operations.

7.2. The Donor shall address any payment-related complaints to: - the Streamer - as the payment recipient; - YooKassa - as the payment operator.

7.3. EchoTip is not a party to the payment relationship between Donors and Streamers, does not hold or retain donor funds, and cannot process refunds of donations. A refund may only be initiated through YooKassa upon the Donor's request to the Streamer.

8. Prohibited Content

8.1. When using the Platform, it is prohibited to send or publish: - material promoting hatred, discrimination or violence; - sexually explicit content involving minors; - calls to extremism or terrorism; - personal data of third parties without their consent; - material that infringes intellectual property rights; - spam or malicious links; - any other content prohibited by the legislation of the Russian Federation.

8.2. EchoTip does not pre-moderate donor messages in real time. The Streamer is solely responsible for the content displayed on their stream.

8.3. EchoTip may suspend a Streamer's account for repeated violations of this section without any refund.

9. Limitation of Liability

9.1. The Service is provided on an "as-is" basis. EchoTip does not guarantee uninterrupted operation and is not liable for temporary unavailability caused by third-party failures or circumstances beyond EchoTip's control.

9.2. EchoTip is not liable for: - the accuracy of exchange rates (provided by third parties, updated with a delay of up to 24 hours); - the quality and availability of TTS narration (Google Cloud TTS, ElevenLabs); - the content of YouTube videos; - the actions and policies of YooKassa; - losses arising from the actions of payment systems or third parties; - the Streamer's tax consequences; - the inability to refund donations (as EchoTip does not hold those funds).

9.3. EchoTip is not liable for failure or improper performance of its obligations caused by force majeure circumstances: natural disasters, military actions, government decisions, Internet infrastructure failures or any other circumstances beyond EchoTip's reasonable control.

9.4. EchoTip's total liability to the Streamer shall not exceed the subscription fees paid for the last 3 months.

9.5. EchoTip does not control and bears no responsibility for the activities of Streamers or for any content they publish or broadcast, including but not limited to: - text, images, audio, video and other materials on a Streamer's page, in their broadcasts and in donation messages displayed via the overlay; - the statements, conduct and actions of a Streamer towards Donors or third parties; - any goods, services, promises or rewards offered by a Streamer; - the lawfulness of a Streamer's activity and their compliance with tax and other legislation.

Streamers publish and broadcast content independently and at their sole responsibility. EchoTip merely provides the technical means of display and is not the author, publisher or moderator of such content. Any complaints relating to a Streamer's content, actions or conduct shall be addressed directly to that Streamer.

9.6. EchoTip may carry out scheduled and unscheduled maintenance during which the Service or certain features may be temporarily unavailable. EchoTip is not liable for any losses, including missed donations or broadcast disruptions, arising during such maintenance, server or network infrastructure failures, or infrastructure attacks (DDoS and similar).

10. Intellectual Property

10.1. All rights to the Platform's code, design, interface and trade marks belong to EchoTip.

10.2. The Streamer retains rights to content they publish and grants EchoTip a limited licence to store and display such content solely for the purpose of providing the Service.

11. Changes to the Agreement

11.1. EchoTip may amend this Agreement with at least 14 days' notice via the Website or email.

11.2. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

11.3. EchoTip may unilaterally amend subscription plans, pricing, available features and per-plan limits at any time. Current pricing and feature information is published at /pricing. Price changes do not apply to already-paid subscription periods.

12. Governing Law and Disputes

12.1. This Agreement is governed by the laws of the Russian Federation.

12.2. Disputes shall be resolved by negotiation; failing agreement, in the courts at EchoTip's location.

12.3. In the event of any discrepancy between the Russian and English versions of the Agreement, the Russian version shall prevail.

13. Saving Payment Documents

13.1. After each subscription payment, the Streamer receives an electronic self-employed/sole-trader receipt via Russia's Federal Tax Service. We recommend saving copies of these receipts (or the email delivering them from YooKassa) until the end of the paid period and the statutory tax review window (typically 3 years). This simplifies dispute resolution and tax filings.

14. Recommendations for Protecting Your Account

14.1. EchoTip applies technical measures to protect user data (see Privacy Policy), but account security also depends on the user's actions. We recommend:

- using a unique password of at least 12 characters; - enabling two-factor authentication wherever possible (in the connected OAuth services - YouTube, Telegram, YooKassa); - not sharing sign-in credentials with third parties; - checking the site address (echotip.app) before entering credentials; - using up-to-date browser and operating system versions.
